Das Bürgerliche Recht in Deutschland kennt zwar Verbraucherschutzvorschriften, erwähnt aber nicht den Verbraucher. Negatives Abgrenzungskriterium ist vielmehr der Kaufmannsbegriff. Dieser wird jedoch vielfach als veraltet bezeichnet (Stichwort: Unternehmensrecht). Die europäischen Nachbarn verwenden teils weitere Begriffe, teils definiert man den Verbraucher unmittelbar. Neben den praktischen Abgrenzungsfragen, insbesondere bei Vorschriften zu AGB und zum Konsumentenkredit, behandelt die Arbeit die dahinterstehenden Grundsatzpositionen. Rechtsvergleichend wird zur Tragfähigkeit des Kaufmannsbegriffs Position bezogen und ein Weg zur Harmonisierung der Lösungssätze gewiesen.
