Angesichts der sinkenden Kaufkraft sichert nahezu jeder Erbbaurechtsbesteller den Wert des vom Erbbauberechtigten zu zahlenden Erbbauzinses durch eine Anpassungsklausel. Da derartige Anpassungsklauseln zu sozial nicht vertretbaren Erhöhungen des Erbbauzinses geführt haben, hat der Gesetzgeber in der Absicht, die sozialpolitische Zielsetzung der ErbbRVO wiederherzustellen, das Erbbaurechtsverordnungs- änderungsgesetz vom 8.1.1974 verabschiedet. Insbesondere die Einführung des 9a ErbbRVO hat in der Praxis wegen der rückwirkungs- ähnlichen Überleitungsregelung eine Fülle von Zweifelsfragen aufgeworfen. Diese zusammenfassend darzustellen und zu klären ist das Ziel der Arbeit.
