Der Widerruf der Approbation wegen Unwürdigkeit stellt einen tiefgehenden Eingriff in die Berufsfreiheit des einzelnen Arztes dar. Angesichts der Schwere dieses Eingriffs verwundert es, dass in der behördlichen Praxis dies ohne großen Begründungsaufwand geschieht. Neben der Darstellung der exzessiven Interpretation des unbestimmten Rechtsbegriffs und der dahinterstehenden Intention, zielt die Arbeit darauf ab, aufzuzeigen, was unter dem eigentlichen Vertrauen der Patienten in die Ärzteschaft zu verstehen ist. Ausgehend davon, will die Arbeit verdeutlichen, dass ein ausreichender Schutz dieses Vertrauens, wie auch in den untersuchten anderen Teilrechtsgebieten des besonderen Verwaltungsrechts, ausschließlich mit dem Begriff der Unzuverlässigkeit erreicht werden kann.
