In Italien gehören organisierte kriminelle Gruppen zur Geschichte des Landes, während Österreich ihr Vorhandensein noch in den 1990er Jahren negierte. Die Mitwirkung des Einzelnen in einer solchen Organisation und beim Menschenhandel stellt, gerade im Hinblick auf die Umsetzung der UN-Konvention von Palermo und des Zusatzprotokolls gegen den Menschenhandel, die nationalen Gesetzgeber vor nicht zu unterschätzende Probleme. Ein Delikt mit zwingender Beteiligung mehrerer ist wesentlich schwieriger in die nationale Strafgesetzgebung zu implementieren als der Menschenhandel, bei dem der Einzelne für seine eigene (Teil-)Handlung zur Verantwortung gezogen werden kann.
