Die Europäische Kommission gibt natürlichen oder juristischen Personen die Möglichkeit, mittels einer Beschwerde einen Verstoß gegen Gemeinschaftsrecht anzuzeigen. Die Arbeit untersucht die Frage, ob es möglich ist, hieraus einen Anspruch auf Durchführung eines Vertragsverletzungsverfahrens herzuleiten. Dabei wird insbesondere die Möglichkeit geprüft, diesen Anspruch im Wege einer Nichtigkeitsklage durchzusetzen. Im Mittelpunkt der Erörterungen steht die Frage, in welchen Konstellationen unmittelbare und individuelle Betroffenheit i.S.d. Art. 230 Abs. 4 EG vorliegen kann. Hierbei ist vor allem die Kontrolle der richtigen Anwendung des Gemeinschaftsrechts im Einzelfall von Bedeutung. Flankierend werden die Möglichkeiten einer Untätigkeits- sowie einer Amtshaftungsklage thematisiert.
