Will man sich ein angemessenes Bild von der Justiz im Dritten Reich machen, interessiert in erster Linie der damalige Alltag der Justiz. Das von 1934 bis 1938 geführte «Diensttagebuch Gürtner» dokumentiert wie kaum eine andere zeitgeschichtliche Quelle diesen Alltag als eine Art chronique scandaleuse aus den Anfangsjahren der nationalsozialistischen Herrschaft. Neben einer Vielzahl interessanter Themen beschreibt das Diensttagebuch, wie die Nationalsozialisten auf Justiz und Richterschaft mehr oder weniger erfolgreich Einfluß nehmen; es geht im Schwerpunkt um «Richterdisziplinierung». Das Instrumentarium hierfür ist reichhaltig, insbesondere Personalpolitik, Parteigerichtsbarkeit und vereinzelte unmittelbare Einschüchterungen. Echter Widerstand zeigt sich nicht, vielmehr Anpassung, obwohl Handlungsspielräume der Justiz bis 1938 erhalten bleiben.
