Ist es gerecht, einen Drogenkonsumenten wegen Betäubungsmittelbesitzes zu bestrafen, der damit zunächst nur sich selbst schädigt? Verdient derjenige Strafe, der einen anderen auf dessen Verlangen hin tötet oder verletzt? Der Autor prüft diese grundsätzlichen Fragen anhand der Rechtsphilosophie Immanuel Kants. Er zeigt dabei auf, daß die Bestrafung eines bloß selbstschädigenden oder konsentiert fremdschädigenden Verhaltens ungerecht ist, weil dies alleine kein Unrecht darstellt, das Strafe gerechter Weise vergelten könnte. Die Folgen dieses liberalen Gehalts des Vergeltungsgedankens für die Strafrechtsdogmatik und für die Diskussion um die Legitimität ""opferloser"" Delikte werden eingehend untersucht. Ein Gesetzgebungsvorschlag zu § 228 StGB rundet das Werk ab.
