§ 426 Abs. 1 BGB begründet eine gesetzliche Ausgleichspflicht zwischen Gesamtschuldnern. Doch besteht das Risiko, dass dieser Anspruch bereits verjährt ist, bevor im Außenverhältnis an den Gläubiger geleistet und an einen Rückgriff überhaupt gedacht wurde. Um dies im Kartellrecht zu vermeiden, wurde im Zuge der Umsetzung der Kartellschadensersatzrichtlinie mit § 33h Abs. 7 GWB eine Norm geschaffen, die für den Verjährungsbeginn auf den Zeitpunkt der Befriedigung des Primärgläubigers abstellt. Diese Regelung weicht von der bisherigen Rechtsprechungspraxis des BGH ab und soll eine effektive Durchsetzung des Ausgleichsanspruchs zwischen Gesamtschuldnern ermöglichen. Christian Dietz untersucht, ob eine entsprechende Änderung auch in anderen Rechtsgebieten wie beispielsweise dem Baurecht, dem Steuerrecht und dem Gesellschaftsrecht angeraten ist, und wie diese umgesetzt werden könnte.
