Das deutsche Vollstreckungsrecht wird von zwei gegenläufigen Prinzipien bestimmt: In der Einzelzwangsvollstreckung gilt das Prioritätsprinzip, im Insolvenzverfahren herrscht dagegen der Gläubigergleichbehandlungsgrundsatz. Dieser fundamentale Widerspruch im Vollstreckungsrecht konnte bis zum heutigen Tage systematisch nicht aufgelöst werden. Das Prioritätsprinzip im Einzelzwangsvollstreckungsrecht wird als freiheitliches, durch die Privatautonomie fundiertes Verteilungsprinzip gepriesen und die Gläubigergleichbehandlung in der Insolvenz zur rechtfertigungsbedürftigen Ausnahme erklärt. Jan Felix Hoffmann versucht unter Einbeziehung des Insolvenzanfechtungsrechts, des europäischen Insolvenzrechts und des französischen Vollstreckungsrechts die Vorstellung zu widerlegen, das Prioritätsprinzip sei Ausdruck materieller Verteilungsgerechtigkeit. Auf dieser Grundlage entwickelt er eine Vollstreckungsgesamtsystematik, die international anschlussfähig ist. Auch das besondere Problem des Doppelverkaufs wird thematisiert.
