Welchen Spielraum hat ein Strafgericht in der Rechtsanwendung? Wie weit reicht seine Entscheidungskompetenz? Diese grundsätzlichen Fragen gewinnen an Relevanz, wenn die Anwendung sogenannter normativer Tatbestandsmerkmale in Rede steht. Während gängige Ansätze in der Strafrechtswissenschaft diese Gesetzeselemente primär im Hinblick auf den Tätervorsatz beleuchten, widmet Kuhli sich den normativen Merkmalen unter dem Blickwinkel ihrer richterlichen Anwendung. Er zeichnet hierfür zunächst die historische Entwicklung des Konzepts normativer Elemente nach, um auf dieser Basis ein eigenes sprachtheoretisches Modell zu entwerfen. Die sich anschließende Untersuchung grundlegender Anwendungsprobleme behandelt den gegenwärtigen Diskurs über Beurteilungsspielräume in der Revision und Fragen der strafrichterlichen Bindung an zivilgerichtliche Entscheidungen.
