Das Werk befasst sich mit der Legitimität des im Jahre 2017 in Kraft getretenen und seitdem in der Literatur stark umstrittenen Straftatbestands der des Sportwettbetruges (§ 265c StGB). Den Schwerpunkt der Arbeit bildet die ausführliche Prüfung der Rechtmäßigkeit der Pönalisierung des Sportwettbetruges. Hierfür erörtert der Verfasser zunächst die Voraussetzungen einer rechtmäßigen Pönalisierung und prüft sodann, sowohl anhand der Maßstäbe der durchaus heftig diskutierten systemkritischen Rechtsgutslehre, als auch anhand der Maßstäbe des Verhältnismäßigkeitsgrundsatzes, ob es sich bei dem Sportwettbetrug um einen legitimen Straftatbestand handelt oder ob sich das Gesetz in die zunehmend länger werdende Reihe symbolischer Straftatbestände einreiht.
