National Australia Bank) noch die europaische Rom II-Verordnung zu hinreichender Vorhersehbarkeit und Rechtssicherheit fuhren. Das gefahrdet samtliche Ziele beider Kollisionsrechte. Streitigkeiten koennen nicht effizient beigelegt werden; Anleger und Markt sind nicht hinreichend geschutzt. Abschliessend legt der Autor einen Reformvorschlag vor, mit dem sich diese Defizite jedoch beheben lassen.
